1. Scope

These Terms and Conditions (AGB) govern the contractual relationship between Claudia Jahn Coaching (hereinafter referred to as "we" or "us") and our clients (hereinafter referred to as "you") who use our coaching services, courses, and digital products via thrivewithclaudia.eu.

3. Nature of Services

We provide coaching services, digital courses, and downloadable materials to help individuals achieve their personal or professional goals.

Coaching services are non-therapeutic and non-medical and do not replace the services of a licensed healthcare provider, therapist, or financial advisor.

Results are dependent on the client's commitment, effort, and personal circumstances; therefore, no specific outcomes can be guaranteed.

I support clients in recognizing and releasing stress, limiting beliefs and behavioral and thought patterns with the goal of reducing stress and tension and nourishing their own strengths and self-management abilities and relaxation. I do not diagnose, heal or treat. My support/coaching does not replace a visit to a doctor or treatment by a doctor or therapist. Please clarify health issues with your doctor and continue to take prescribed medication.

4. Offer and Conclusion of Contract

The listing of coaching programs and digital products on our website does not constitute a legally binding offer.

By purchasing a program or service, you are making a binding offer, which we accept once we send a confirmation email.

All agreements between us and the client are made in writing or via electronic communication.

5. Prices and Payment Terms

All prices include the applicable statutory VAT (MwSt.) where required.

Payment is due before access to digital content or coaching sessions unless otherwise agreed in writing.

6. Access to Digital Products and Coaching Services

Digital Products: Upon payment, you receive a non-transferable, non-exclusive license to access purchased content. You may not share, distribute, or resell any materials.

Live Coaching Sessions: Rescheduling must be requested at least 24 hours in advance; otherwise, the session is considered completed and non-refundable.

Group Coaching Programs: No refunds or transfers once a program has started.

7. Right of Withdrawal (Widerrufsrecht)

For Digital Products:

• As per § 356 (5) of the German Civil Code (BGB), you waive your right of withdrawal once you access or download a digital product.

• You will be informed of this waiver before completing your purchase.

For Coaching Services:

• You may withdraw from a contract within 14 days if the coaching program has not yet started.

• If services have already been provided within the 14-day period, you may receive a partial refund, deducting the value of services already rendered.

8. Refund Policy

Due to the nature of digital products and coaching services, refunds are not guaranteed unless required by law.

If a refund is granted, it will be processed using the original payment method.

In cases of dispute, we will comply with German consumer protection laws.

9. Intellectual Property & Copyright

All materials, courses, and coaching content provided by us are protected under copyright law.

You may not:

Share, resell, or reproduce any content.

Use our coaching frameworks, materials, or strategies for commercial purposes without explicit written permission.

Unauthorized distribution may lead to legal action.

10. Disclaimer & Limitation of Liability

Our coaching services are for educational and informational purposes only.

We do not provide medical, legal, or financial advice, and we do not guarantee specific results.

We are only liable for gross negligence and intent under German law. In cases of slight negligence, we are only liable for breaches of essential contractual obligations (cardinal obligations), and liability is limited to foreseeable damages.

You are responsible for your own success in implementing the strategies learned.

11. Dispute Resolution & Jurisdiction

The European Commission provides a platform for online dispute resolution (ODR): http://ec.europa.eu/consumers/odr/

We are neither obliged nor willing to participate in consumer dispute resolution proceedings before a dispute resolution body.

All legal disputes shall be governed by German law and take place in [City, Germany], unless otherwise required by consumer protection laws.

12. Final Provisions

If any provision of these Terms and Conditions is invalid, the remainder of the contract remains valid.

Any modifications to these terms must be agreed upon in writing.
